Terms and conditions

The present conditions apply between the company named "Côme" (simplified joint stock company) whose registered office is at 42 rue Sainte-Anne 75002 Paris, registered with the Trade and Companies Register of Paris, under the number 794 642 694 , represented by its President, Miss Clémence DRU) and secondly, people wishing to make a purchase on the website of Côme (www.come-editions.fr), hereinafter referred to as "the customer". These conditions only concern non-commercial individuals. The parties agree that their relations will be governed exclusively by this contract, excluding any conditions previously available on the site. If a condition were to fail, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.


These conditions are intended to define the terms of sale between Côme and the customer, from ordering to services, through payment and delivery. They regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the contracting parties.

2. Order

Any order conforms to the acceptance of the prices and description of the products available for sale. Any dispute on this point will occur in the context of a possible exchange and the guarantees mentioned below. Côme undertakes to honor orders received on the website only within the limits of available stocks of products. In the absence of availability of the product, Côme agrees to warn the customer.

3. Shipping and delivery

Delivery times indicated are in working days. When a single order concerns several Products and they have different delivery dates, the delivery date of the order to be taken into account is the one mentioned as the furthest, subject to the possibility, for Côme, to split the shipments. In this case, the participation in the processing and shipping costs will only be charged for one shipment. The products are delivered to the delivery address indicated by the Customer at the time and within the scope of his order. Unless otherwise indicated on the Site, deliveries of Products occur in France as well as in the rest of the world. No delivery will be made to hotels, business addresses or PO boxes. In case of delay of shipment, an email of information will be sent to the Customer and a new date will be proposed. If the delivery delay should exceed 7 days for causes other than force majeure, the Customer will benefit from the possibility of canceling his order by sending a registered letter with acknowledgment of receipt to the customer service of Côme, to the address from its registered office within 60 working days from the originally scheduled delivery date. The sums paid by the Customer under the order and shipping costs will be refunded. If the Product has been received after the date of receipt of the cancellation by Côme, the return costs will be borne by the Customer, and the return of the Products will be accepted only subject to a perfect condition of Products, in their original packaging. Any reservation on the condition of the Products (eg open or damaged parcel) must be notified immediately at the time of delivery to the carrier.

4. Price and payment terms

Prices are quoted in euros all taxes included. They take into account the VAT applicable on the day of the order. These prices do not include the cost of processing (shipping, packaging and making the package according to amounts in force). Any applicable rate change may be reflected in the prices of the products. After this date, they are subject to change at any time. However prices can not be changed once the customer's order has been placed. Similarly, if one or more taxes or contributions were to be created or modified, up or down, this change can be reflected in the selling price of the items on the site of Côme. Prices shown on the site are guaranteed for the duration of online and within the limits of available stocks. Orders outside the European Community are invoiced excluding tax (VAT: 20%). They will be taxed at destination according to the local tax charged to the customer. For more details, consult the customs department of your country. The final invoice price to the customer is the price indicated on the order confirmation. The product invoice will be inserted in the package containing the product order.

5. Right of withdrawal, return and exchange

In application of articles L.121-20 and following of the Consumer Code, the Customer has a period of 14 days from the date of delivery of the order to return any Product, in its original packaging and in perfect condition (allowing commercialization), to request exchange or refund without penalty. The Customer must attach a copy of the invoice or any other element to identify the order in question, and its holder. Côme will reimburse the customer the cost of return upon presentation of an invoice for the return costs. If the package is lost or damaged during the return, the cost of damage is the responsibility of the customer. Only the Customer identified as such with Côme may exercise this right, to the exclusion of any other person, including the person to whom the delivery is made. 6. Guarantees

All items are subject to a contractual warranty, which does not preclude the legal warranty provided by articles 1641 and following of the Civil Code. The customer also benefits from a guarantee allowing him to return defective books in accordance with Articles l 211-4 et seq. Of the Consumer Code. The customer is therefore invited to refer to his texts if he wishes to have more precision on these legal warranties.

7. Signature and proof

In any case, the online supply of the credit card number and the final validation of the order will be proof of the completeness of the said order in accordance with the provisions of the law of March 13, 2000 and will be worthy of sums committed by the seizure items listed on the order form. This validation is worth signing and express acceptance of all the operations carried out on the site. On the other hand, the responsibility of Côme could not be engaged in the case where the non-performance of its obligations would be attributable either to the unpredictable and insurmountable fact of a third party to the contract or to a case of force majeure as defined by the French jurisprudence. Similarly, Côme can not be held liable for any inconvenience or damage inherent to the use of the Internet, including a break in service, external intrusion or the presence of computer viruses. All elements of the site Côme, whether visual or sound including the underlying technology, are protected by copyright, trademarks or patents. The customer who has a personal website and who wishes to place a simple link for his personal use on his site directly to the home page of the site of Côme must compulsorily ask permission to Côme. In any case, any link, even tacitly authorized, must be withdrawn upon simple request from Côme. In the event that one of the clauses of the present contract would be null and void by a change of legislation, regulation or by a court decision, this can not in any way affect the validity and the respect of the present general conditions of sale. These conditions apply throughout the duration of online services offered Pacôme. The filing of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code. These conditions are subject to French law. The court in case of dispute will be that of the place of residence of the defendant or, at the option of the plaintiff of the place of actual delivery of the product.
